Acceptance of terms
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Services.
The w3worker platform
w3worker provides a two-sided hiring platform that connects organizations hiring talent with workers seeking employment. Features may include job postings, application workflows, candidate profiles, assessments, interviews, analytics, and related tools. We may add, change, or remove features over time.
Accounts and eligibility
You must provide accurate registration information and keep your account credentials secure. You are responsible for activity under your account. You must be at least 16 years old and legally able to enter into these Terms to use the Services.
Organization accounts
Organizations using w3worker to hire are responsible for their job postings, hiring decisions, compliance with employment and anti-discrimination laws, and how they use candidate information obtained through the platform. w3worker does not guarantee hiring outcomes or the suitability of any candidate.
Worker accounts
Workers may create profiles, submit applications, and participate in hiring processes made available through the platform. You represent that information in your profile and applications is truthful and that you have the right to share any content you upload, including résumés and portfolio materials.
Acceptable use
You agree not to:
- Use the Services for unlawful, fraudulent, or discriminatory purposes
- Scrape, reverse engineer, or attempt to bypass platform security
- Upload malware or content that infringes third-party rights
- Harass other users or misrepresent your identity or affiliation
- Interfere with the operation or integrity of the Services
Content and intellectual property
w3worker and its licensors own the Services, software, branding, and platform content, except for content you or other users submit. You retain ownership of content you submit, but grant w3worker a license to host, use, display, and process that content as needed to operate the Services and facilitate hiring workflows.
Third-party services
The Services may integrate with or link to third-party tools. Your use of those tools is subject to their own terms and policies. w3worker is not responsible for third-party services.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, W3WORKER AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).
Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Services. Sections that by their nature should survive termination will continue to apply.
Changes to these terms
We may modify these Terms from time to time. If we make material changes, we will provide notice through the Services or by other reasonable means. Continued use after changes become effective constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory local law applies.
